SurfMatch — Terms of Service

1. Acceptance of Terms

By accessing or using the SurfMatch web or mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please discontinue use of the App.

2. Description of Service

SurfMatch provides surf, swell, wind, tide, and weather forecast information, alongside AI-driven coaching and travel recommendations, utilizing varied third-party data sources. You acknowledge and agree that the service is provided “as is” without warranties of any kind. Ocean and weather forecasts are inherently predictive and may occasionally be incomplete, delayed, or inaccurate.

3. Subscriptions and Billing

SurfMatch offers premium tiers and features ("SurfMatch Pro") via auto-renewing subscriptions. By activating a premium tier, you agree to the following framework:

• Payment will be charged securely to your Google Play Store or Apple App Store account at the confirmation of purchase.
• Subscriptions automatically renew at the original rate unless auto-renew is turned off or canceled at least 24 hours before the end of the current billing sequence.
• You can modify, manage, or cancel your subscription terms at any time directly within your mobile device's native app store account subscription settings. SurfMatch cannot process cancellations or handle refunds directly.

4. User Accounts

To utilize specific personalization capabilities, you may be prompted to register an account using your email address. You agree to:

• Provide accurate and current registration information.
• Maintain the comprehensive confidentiality of your native login credentials.
• Be fully accountable for all system queries and activities that occur under your account session.

5. AI Intelligence & Travel Estimates

SurfMatch leverages advanced generative frameworks (“SurfMatch Intelligence”) to assist with quiver matching, localized surf analysis, and flight itinerary routing estimations.

• Travel Concierge: Flight price matrices and scheduling data provided within the App are real-time, algorithmic estimates pulled from external flight platforms. SurfMatch does not function as a travel agency, does not sell transit ticketing directly, and cannot lock down or guarantee structural route costs or availability.
• AI Guardrails: While engineered for operational accuracy, automated messaging can occasionally experience technical generation variances. Users are expected to verify routing variables and coastal beach observations independently.

6. Acceptable Use

You strictly agree NOT to:

• Reverse-engineer, copy, disassemble, or systematically scrape any SurfMatch data feeds, custom buoy calculations, or core application code blocks.
• Utilize SurfMatch data streams for commercial redistribution or resale operations without explicit written validation.
• Interfere with or systematically compromise the standard functionality, runtime performance, or cloud infrastructure security of the App.

7. Limitation of Liability and Ocean Safety

Your decision to paddle out into the ocean is made entirely at your own risk. Always deploy your own manual assessment, understand your precise physical capabilities, and respect local safety guidelines before entering the lineup.

8. Termination

SurfMatch reserves the right to suspend, restrict, or entirely terminate access to the App platform at any juncture, without prior warning, for actions violating these boundary Terms. You retain the absolute right to delete your user account framework and halt app use at any time.

9. Changes to These Terms

We reserve the right to revise or update this legal manual cleanly as the product optimizes. Continued usage of the SurfMatch application following an update protocol flags your full binding acceptance of the revised terms.
