SurfMatch — Terms of Service

1. Acceptance of Terms

By accessing or using the SurfMatch web or mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please discontinue use of the App.

2. Description of Service

SurfMatch provides surf, swell, wind, tide, and weather forecast information using third-party data sources. During the beta phase, SurfMatch is available at no cost. In the future, certain features, enhanced forecast tools, or premium functionality may require a paid subscription.

3. Beta Use and Disclaimer

SurfMatch is currently offered as a beta product. Forecast accuracy, availability, and performance may vary. You acknowledge and agree that:

• The service is provided “as is” without warranties of any kind.
• Forecasts or location-based results may be incomplete, inaccurate, or unavailable.
• Features may change, break, or be removed during the beta period.

4. User Accounts

To use certain features, you may be required to create an account using your email address and password. You agree to:

• Provide accurate registration information.
• Maintain the confidentiality of your login credentials.
• Be responsible for all activity that occurs under your account.

5. Future Paid Features

SurfMatch may introduce optional paid tiers (“Premium Features”). If paid features are added, pricing and billing terms will be clearly communicated before purchase. Users will never be charged without explicit consent.

6. Acceptable Use

You agree NOT to:

• Reverse-engineer, copy, or scrape SurfMatch data or code.
• Use SurfMatch for commercial resale without permission.
• Interfere with the functionality, performance, or security of the App.

7. Third-Party Services

SurfMatch uses third-party providers for weather and forecast data. SurfMatch is not responsible for accuracy, delays, outages, or data errors caused by these external partners.

8. Limitation of Liability

SURFMATCH IS NOT RESPONSIBLE FOR:

• Surf conditions, hazards, or ocean safety outcomes.
• Forecast inaccuracies or missing data.
• Damages arising from reliance on forecast information.

Your use of the App is entirely at your own risk. Always use your own judgment and follow local surf safety guidelines.

9. Termination

SurfMatch may suspend or terminate access to the App at any time, for any reason, including violations of these Terms. You may delete your account and discontinue use at any time.

10. Changes to These Terms

We may update these Terms from time to time. If material changes are made, users may be notified through the App or the website. Continued use of the App after changes constitutes acceptance of the updated Terms.
